Overview
The Upper Merion Township Property Maintenance Appeals Board shall hear and rule on decisions, notices or orders issued pursuant to the Property Maintenance Code of Upper Merion Township by the Upper Merion Township Safety and Codes Enforcement Department and/or the Upper Merion Township Police Department.
Any person directly affected by the Upper Merion Township Property Maintenance Code decision or a notice or order issued under the Township’s Property Maintenance Code shall have the right to appeal to the Upper Merion Township Property Maintenance Appeals Board. An application for appeal shall be filed within 20 days after the day the decision, notice or order was served. The appeal shall be based on a claim that the true intent of the Township Property Maintenance Code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of the Township Property Maintenance Code do not fully apply or the requirements of the Township Property Maintenance Code are adequately satisfied by other means.
Membership
The Upper Merion Township Property Maintenance Appeals Board shall consist of a minimum of three (3) members appointed by the Upper Merion Township Board of Supervisors who are qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of the jurisdiction.
Alternate Members
The Board of Supervisors shall also appoint two or more alternate members who shall be called by the Property Maintenance Appeals Board Chairman to hear appeals during the absence or disqualification of a member. Alternate members shall possess the qualification required for Board membership.
